That is useful advice. I tell my estate planning clients in Japan that a typical plan involves first, careful analysis and only then, several documents, only one of which is the will. There are several objectives, including asset disposition, cost savings, provision for minor and special needs children, generation skipping, health care and financial authority when one is incapacitated, etc. -- and a will alone will not cover these. There are clients who only need a simple will, but the person with a family is unlikely to be in that category. In Japan, so many companies (even giant ones) are family businesses, so business succession planning is also needed.

Victor, your postscript is so perfect: It's exactly what I tell my clients - the document is free, it's the question and answer session, and the working together to decide what's right for you that has value. People are usually surprised how much time and work it takes to do good planning. I hope a few readers take you up an this amazing evaluation fee waiver. it's a no risk way to decide if you are the lawyer for them.

Victor: this is a wonderful article. From those of us who know to those of you who don't: this is no advertising propaganda--It is absolutely correct. It tells us why we have so much trouble explaining the difference between counselling and design vs the drafting of "its."

Victor, You are exactly right! Do-it-yourself estate planners and those who shop for a lawyer based only on the cost of estate planning "documents" often pay a much steeper price than what it would have cost to plan properly at the outset. Anyone can check out the "Estate Planning Horror Stories" on my website for real world examples of such "penny-wise and pound foolish" thinking.

I love your pad answer "it's free" - mind if I borrow it to try it out? I also get that question a lot (everywhere I go, not just people who call my office) & feel frustrated trying to answer such a short, direct, uninformed question that deserves this blog post's length & more of an answer.

Hello Victor,

I'm a Mexican attorney (corporate & tax) but, to be honest, I am curious about this "estate planning" thing... I mean, it is not customary in Mexico for attorneys to practice "estate planning"... wills are, by law, done before notary publics and are usually very simple documents just stating who will inherit all of the estate of the persona who past away...

Could you please just give me an overall explanation of what an estate planning attorney does in the USA?

Thanks a lot for your time. Best Regards.
